Preparing your business for India’s new Digital Personal Data Protection Bill, 2022

World Trade Center in association with NASSCOM conducted an interactive session on the Digital Personal Data Protection Bill, 2022 (“Bill”). Juris Corp Advocates & Solicitors was the knowledge partners for the event. Speakers from Juris Corp included – Mr. Jayesh H, Co-Founder; Mr. Neeraj Dubey, Partner; Ms. Namrta Rai, Partner and Mr. Vedanarayanan Lakshmanan, Partner.

Mr. Jayesh H. spoke about the Data Protection Bill and its relevance. The various iterations of the Data Protection Bill require an updated, industry specific set of laws. He opined that there would be very little overlap of the sensitive data the bill seeks to protect and the data that is being held by fiduciary.

Mr. Neeraj Dubey gave a timeline of the Data Protection Bill in India which started with the Puttuswamy Judgement in 2017. The principles underlying the Data Protection Bill are - Lawful, fair & transparent usage, purpose limitation, data minimisation, accuracy of personal data, storage limitation, reasonable safeguard and accountability. Mr. Dubey listed the rights of the parties, duties and penalties.

Mr. Vedanarayanan Lakshmanan spoke about data protection with respect to the banking industry. He gave a detailed explanation about the RBI guidelines on information security, electronic banking, technology risk management and cyber frauds.

Ms. Namrta Rai discussed the data protection in the health sector. She gave a comparison of the existing laws with the 2022 bill. She spoke about the 'Health Data Management Policy' which is a framework for protecting patients' rights. She also gave an overview of the 'DISHA Bill'. 

Mr. Vivek George, Senior Manager, World Trade Center moderated the session and Mr. Sujith Unni, Regional Head, NASSCOM delivered the concluding remarks.
