With the global shift to use of technology, the quantum of data flow has increased tremendously. The number of cases of data breach have been increasing significantly, which has led to the need for a comprehensive data protection law in India. The Personal Data Protection Bill, 2019 (“Bill”)- modeled on similar concepts of European Union’s General Data Protection Regulation (GDPR), undoubtedly is a welcoming step to ensure the protection of sensitive personal data and has garnered a lot of praises as well as criticisms.
The Bill recognizes individuals as ‘data principals’ and ensures privacy rights. Data Fiduciaries- the entities which collects, retain and in online or offline form shall fall under the purview of this law. It provides various obligations that an entity shall have to comply with, such as, consent of data principal before processing any data. The Bill’s data localization requirements and cross border data transfer restriction have a considerable impact on multi-national companies operating within the country. Such stringent regulations have been implemented for a more reliable data protection framework.
